Terms and Conditions for using Lugsy luggage storage

Effective from: [DATE TO BE COMPLETED]

These Terms and Conditions set out the rules for using the self-service Lugsy luggage lockers at Starowiślna 66D in Krakow, available 24 hours a day, 7 days a week.

1. Operator and definitions

The service is operated by [FULL COMPANY NAME], [REGISTERED OFFICE ADDRESS], Polish tax identification number (NIP): [NIP], email: info@lugsygo.com, hereinafter the “Operator”.

  • User – a person making a reservation or using a locker.
  • Locker – a self-service luggage locker in size S, M or L.
  • Reservation – an order to rent a locker for a selected period.
  • Access code – an individual code or other details enabling the locker to be opened.

2. Scope of the service

The service consists of short-term, self-service rental of a luggage locker for 6, 12 or 24 hours. Reservations can be made online or on site. Availability of a particular size depends on current occupancy.

3. Reservations

  • Before confirming a reservation, the User selects the locker size and rental duration and checks the price.
  • The User should provide correct contact details needed to handle the reservation.
  • The Operator is not responsible for failure to deliver an access code or information caused by incorrect details supplied by the User.

4. Formation of the contract

The contract is concluded when the reservation is confirmed and payment is accepted. Confirmation and access details may be sent to the email address or telephone number provided, or displayed in the booking system.

5. Payment

The fee is charged in advance according to the price list shown before payment. The price covers the selected locker size and rental period. Available payment methods are indicated in the booking system or at the terminal.

6. Locker access and access code

  • The access code is intended only for the User and anyone with whom the User knowingly shares it.
  • The User should protect the code from third parties and check that the locker is properly closed after each use.
  • The Operator is not liable for the consequences of voluntarily sharing the code with a third party, subject to mandatory provisions of law.

7. Rental period

The rental period runs according to the period specified in the reservation confirmation. The User should collect all belongings and vacate the locker before the reservation ends.

8. Repeated access to the locker

During an active rental, the User may open and close the locker multiple times. Each time, the User must ensure that the locker has been properly closed. Opening the locker during the rental does not extend the reservation.

9. Extensions and exceeding the rental period

If the system allows the rental to be extended, this must be done before the active reservation ends. Extensions depend on locker availability.

For each additional 24-hour period started after the paid period ends, a fee of 50% of the current 24-hour price for the relevant S, M or L locker may be charged. The Operator may contact the User about collecting their belongings and paying the fee due.

10. User obligations

  • use the locker for its intended purpose and follow the instructions;
  • choose a locker suitable for the size of the luggage, without using excessive force;
  • do not leave belongings outside the locker or in passageways;
  • take care of the locker and report any damage or irregularities noticed;
  • collect all belongings before the reservation ends.

11. Prohibited items

In particular, the following must not be stored in the lockers:

  • explosive, flammable, toxic, corrosive materials and other hazardous substances;
  • weapons, ammunition and items intended to cause harm;
  • drugs, illegal substances and items obtained through crime;
  • live animals and plants requiring special conditions;
  • perishable food and items emitting strong odours or liable to soil the locker;
  • items whose possession, transport or storage is unlawful.

Storing money, documents, keys, jewellery, securities, media containing unsecured data or particularly valuable items is not recommended. The User leaves such items at their own risk, subject to rights that cannot be excluded.

12. Safety and CCTV

The premises may be monitored by CCTV to protect people and property and prevent misuse. The Privacy Policy describes how personal data is processed. The User must not cover cameras, damage security measures or obstruct other people’s use of the premises.

13. Operator’s right to open the locker in an emergency

The Operator may open the locker remotely or using an emergency procedure where necessary due to a fault, a safety risk, reasonable suspicion of a breach of these Terms or the law, a request from authorised authorities, or belongings left after the rental ends. Where possible, the action will be documented.

14. Locker or system failure

If the code does not work, the locker or terminal will not open, the User cannot access their luggage, or there is a power or system failure, contact Lugsy:

The User should provide the reservation number, locker number, date and time, and a description of the problem. The Operator may carry out diagnostics, open the locker remotely or apply an emergency procedure. The User should not force open or dismantle the locker themselves.

15. Liability

The Operator is liable for failure to perform or improper performance of the service under applicable law. The Operator’s liability for the contents of one locker is limited to PLN 5,000, insofar as such a limitation is permitted by law.

The Operator is not liable for the inherent properties of items, inadequate packaging, damage caused by prohibited items or the actions of people with whom the User shared the code. Nothing in these Terms limits statutory consumer rights or liability that cannot lawfully be excluded or restricted.

16. Luggage left after the reservation ends

  • After the rental ends, the Operator may try to contact the User.
  • After 24 hours, the Operator may open the locker, document the contents and secure them.
  • After 7 days, the belongings may be handed over to the competent authority or entity in accordance with applicable rules on found property.
  • Documents, payment cards, dangerous or illegal items, or items giving rise to reasonable suspicion, may be handed over to the competent authorities earlier.

Further handling of the belongings follows applicable law. The Operator does not acquire ownership of belongings left behind solely because time has passed.

17. Cancellation and the right to withdraw from the contract

A consumer who concludes a distance contract may generally withdraw within 14 days, in accordance with the Polish Consumer Rights Act. A withdrawal statement may be sent to info@lugsygo.com.

If, at the consumer’s express request, the service begins before the withdrawal period expires and the consumer subsequently withdraws, they may be required to pay an amount proportionate to the service performed up to the time of withdrawal. Once the service has been fully performed, the right to withdraw may expire if, before performance began, the consumer gave the required consent and was informed of the loss of this right.

Voluntary cancellation outside the circumstances provided by law may depend on the Operator’s individual decision. This provision does not limit statutory consumer rights.

18. Refunds

A refund is due in cases required by law, in particular where the service cannot be performed for reasons attributable to the Operator. The amount refunded reflects the extent of the service not performed. Refunds are generally made using the same payment method, unless the parties agree otherwise.

19. Complaints

Complaints may be sent to info@lugsygo.com. To help us handle your complaint efficiently, please include:

  • the reservation number;
  • the date and time of the incident;
  • the locker number, if known;
  • a description of the problem and the requested resolution;
  • your contact details.

It is best to report a complaint as soon as possible after the incident, but failure to report it immediately does not limit the User’s statutory rights. Consumer complaints will be handled within the period required by applicable law, generally no later than 14 days.

20. Personal data

Personal data is processed to fulfil reservations, handle payments, ensure safety, communicate and handle complaints, in accordance with the Privacy Policy available on the Lugsy website.

21. Changes to these Terms

The Operator may amend these Terms for important reasons, in particular changes in the law, how the service is provided, technology or safety rules. Changes do not infringe acquired rights or affect reservations made before they take effect, unless mandatory law requires otherwise.

22. Applicable law and final provisions

The contract is governed by Polish law. The choice of Polish law does not deprive consumers of protection afforded by mandatory provisions of the country of their habitual residence, where those provisions apply. Disputes may be resolved by the competent ordinary courts. The invalidity of one provision does not affect the validity of the remaining provisions of these Terms.
